Terms of use.

These terms govern your use of usemagic.io, the Magic app, and the Magic Ring. By using any of them, you agree to these terms.

Who we are

Magic Technologies Inc. (“Magic”, “we”, “us”) provides the Magic Ring, the companion Magic app, and the website at usemagic.io (together, the “Services”). You can reach us at hello@usemagic.io.

Eligibility and accounts

You must be at least 13 years old to use the Services, and at least 18 (or the age of majority where you live) to make a purchase. If you create an account, keep your credentials secure — you are responsible for activity under your account. Give us accurate information and keep it up to date.

Your license to use the app

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Magic app on devices you own or control, for your personal, non-commercial use, subject to these terms. You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract the source code of the Services, except where the law permits it despite this restriction.

Preorders and purchases

Preorder payments are processed by Stripe. A preorder reserves a ring at the stated price and is fully refundable any time before your ring ships; after it ships, our return policy at the time of shipment applies. Shipping estimates are estimates, not guarantees — hardware is hard, and dates can move. Prices may change, but a change will not affect a preorder you have already placed.

Not a medical device

The Magic Ring and app provide wellness information such as steps and sleep for general informational purposes only. They are not medical devices, are not intended to diagnose, treat, cure, or prevent any disease or condition, and are not a substitute for professional medical advice. Always consult a qualified health provider about medical questions, and never disregard professional advice because of something the Services showed you.

Voice capture and smart home control

Some features record audio from the ring and control smart home devices you connect. You are responsible for using these features lawfully: obtain any consent required where you live before recording other people, and only connect and control devices and accounts you own or are authorized to use. Actions the Services perform on connected devices (for example, toggling a light with a gesture) are carried out at your instruction.

Third-party services and beta features

The Services integrate with third-party platforms such as Google Home, Apple HomeKit, Home Assistant, and others. Your use of those platforms is governed by their own terms, and we are not responsible for their availability or behavior. Some features let you supply your own API keys — for example for AI providers or device platforms — and you are responsible for keeping those keys secure, for any charges the provider bills you, and for complying with the provider’s terms. Some features may be offered in a limited beta with restricted availability; beta features are provided as-is and may change or be withdrawn at any time.

Acceptable use

Intellectual property and feedback

The Services, including software, design, and branding, are owned by Magic and protected by intellectual property laws. These terms do not grant you any rights to our trademarks. If you send us feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without obligation to you.

Apple App Store terms

If you downloaded the app from Apple’s App Store, the following also applies: these terms are between you and Magic, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. To the maximum extent permitted by law, Apple has no warranty obligation for the app beyond refunding its purchase price (if any). Apple is not responsible for addressing claims relating to the app, including product liability, regulatory, or consumer protection claims, or third-party claims that the app infringes intellectual property rights. You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Disclaimers

The Services are provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that gesture recognition, transcription, or device control will always work. Nothing in these terms limits any warranty or right that applicable law does not allow to be limited.

Limitation of liability

To the maximum extent permitted by law, Magic will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us in the twelve months before the claim and one hundred U.S. dollars. Some jurisdictions do not allow these limitations, so they may not apply to you.

Indemnification

You agree to indemnify and hold Magic harmless from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Services, your violation of these terms, or your violation of any law or third-party right — including recording others without consent or controlling devices you are not authorized to control.

Termination

You can stop using the Services and delete your account at any time. We may suspend or terminate your access if you violate these terms or if we discontinue the Services, in which case we will make reasonable efforts to give you notice. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) survive.

Governing law

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction. If any provision of these terms is found unenforceable, the rest remains in effect.

Changes to these terms

We may update these terms as the Services evolve. Material changes will be announced in the app or by email before they take effect, and the date at the top of this page always reflects the latest version. Continuing to use the Services after changes take effect means you accept them.
